Terms of service
Last updated 28 September 2026
These terms are an agreement between Stratum ICS, of Georgetown, Guyana, which makes and runs Lotmark (“we”), and the agency that signs up (“you”). They apply to everyone on your team who uses it. We have kept them short and plain; if anything is unclear, ask us at hello@stratumics.com.
The service
Lotmark is software for estate agents: listings and an agency website, enquiries, people and their requirements, viewings, deals, rentals and compliance records. We keep improving it, so features change over time. If we plan to remove something you rely on, we will tell you before we do.
The free trial
A new agency gets 14 days with every feature and no card. When the trial ends, the agency becomes read-only until you choose a plan: nothing is deleted, and your website stays up for 30 days.
Plans, billing and cancellation
- Plans are billed monthly or yearly, in advance, in US dollars. Payments are processed by Polar, and the card payment by Stripe.
- A plan renews automatically at the end of each period until you cancel it.
- You can cancel at any time from Settings, Billing. You keep full access until the end of the period you have paid for. We do not refund part of a period, unless the law requires it.
- If a renewal payment fails, you keep full access for 14 days while the card is updated. After that the agency is read-only until the payment goes through.
- If we change our prices, we will email the account owner at least 30 days before the new price applies, and it applies from your next renewal.
Acceptable use
You agree not to use Lotmark to:
- commit fraud or mislead buyers, tenants or owners;
- market a property you have no right to market, or publish photos or text you have no right to use;
- send messages people have not asked for in bulk;
- break the law, including the law on personal information;
- get into another agency’s records, or test, overload or get around our security.
If an agency breaks these rules, we may suspend it. Where we can, we will tell you why first and give you the chance to put it right.
Your legal duties
You remain responsible for your duties as an estate agent, including those under the Real Estate Agents and Brokers Act and the Anti-Money Laundering and Countering the Financing of Terrorism Act: identifying your clients, keeping records and reporting to the Financial Intelligence Unit. Lotmark helps you keep those records and reminds you of steps, but it is not legal advice. Its checklists and guides are general information; check anything that matters with your attorney or compliance officer.
Your data
- You own it. Everything your agency puts into Lotmark (listings, photos, people, documents and records) belongs to you. You let us store and process it only to run the service for you, including showing your listings on your public website.
- You can take it with you. Download everything at any time from Settings.
- Deleting it. If you delete your agency, its records are removed from Lotmark and later from our backups as they are replaced. The law may require you to keep client records for a number of years, so download them first.
How we handle personal information is set out in the privacy policy.
Availability
We work to keep Lotmark running and your data safe, but we cannot promise it will never be interrupted or free of faults. When something goes wrong, we will fix it as quickly as we can and tell you if it affected your data.
Liability
As far as the law allows, we are not liable for indirect losses, such as lost sales, commission or profit, and our total liability to you is limited to what you paid us in the 12 months before the claim. Nothing in these terms limits a liability that the law does not allow to be limited.
Changes to these terms
If we change these terms in a way that matters, we will email the account owner at least 30 days before the change applies. The date at the top shows when they last changed.
The law that applies
These terms are governed by the laws of Guyana, and the courts of Guyana deal with any dispute about them.
